Damage and Liability Policy
Stoorez Damage and Liability Policy
Effective Date: 20-07-2025
This Damage and Liability Policy ("Policy") describes the responsibilities, limits, and reliefs for all parties in case of property damage, loss, injury, or other liabilities resulting from activity on the Stoorez platform. This applies to both storage and parking and is binding for Hosts, Seekers, and any third-party users.
Stoorez operates an online, app-based platform that facilitates the discovery, booking, agreement, and payment for two main categories:
- Storage Services: Neighborhood Storage, Small Business Storage, and B2B Storage
- Parking Services: Neighborhood Parking and Commercial Parking
- Applies to all use, bookings, and listings processed through the Stoorez platform.
- Covers claims regarding damage to property, loss/theft of items, vehicle incidents, and personal injury, excluding those specifically disclaimed or limited by law or platform terms.
- Stoorez is a technology facilitator only; it does not own, possess, or control any listed Space.
- No Host–Seeker action creates a tenancy, warehouse keeper, or bailment relationship.
- All users are responsible for their own insurance and compliance.
| Incident Type | Seeker's Responsibility | Host's Responsibility | Stoorez's Responsibility |
|---|---|---|---|
| Damage by Seeker to Host space | Fully liable for repair/restoration | Notify Stoorez, provide evidence | Platform mediation; not financially liable |
| Theft/loss from storage space | Liable if proven direct involvement | Secure space, report breach/fault | Not responsible; may facilitate dispute |
| Vehicle damage in parking | Liable if accidental/negligent | Must provide a safe/usable spot | No liability except proven platform error |
| Damage to stored items (fire, flood, pest) | At own risk; must insure contents | Must disclose risks, mitigate hazards | No liability for nature/force majeure |
| Abandoned property removal damage | At Seeker's risk post lawful notice | Remove/handle per local law | Not liable; mediates if process breached |
| Bodily injury (on premises) | At own risk for misuse/fault | Safety/duty of care for listed areas | No liability unless gross negligence |
| Damage during third-party removal (authority, municipal) | At Seeker's risk (property), legal process applies | Legal compliance | Not liable |
Stoorez accepts no liability for:

- Riot, civil unrest, governmental/military action
- Loss or damage due to prohibited items or dishonest declarations

- Should promptly inform Stoorez of any post-use damage and support evidence (photos, video, communication logs).
- May not carry out repairs, disposal, or penalties unless permitted by law/platform or after Stoorez review.
- Should maintain valid property insurance wherever feasible.
- Shall use the Space and parking strictly as per agreed use (storage or parking, not habitation, industrial activity, or subleasing).
- Responsible for any loss, structural damage, soiling, or third-party loss caused by:
- Mishandling, improper storage, or unsafe parking
- Use of hazardous/prohibited materials (see Prohibited Items Policy)

Incident Reporting:
- Must be reported by Host/Seeker within 48 hours of discovery via support@stoorez.com or platform dispute form.
- Provide full documentation (photos, receipts, police report if needed).
Initial Review:
- Stoorez investigates via digital evidence, messages, and call logs.
- Temporary hold on relevant bookings/payouts may occur during review.
Resolution:
- If Seeker is found at fault, Host is entitled to recover reasonable actual repair or cleaning costs, up to provable value.
- In the event of vandalism, theft, or untraceable damage, Hosts must first approach law enforcement (FIR copy shared).
- Payment/recovery is made via:
- Deducted from booking (if funds present)
- Payment demand notice to Seeker
- Suspension or blacklisting of accounts for non-compliance
Dispute Escalation:
Parties may escalate to arbitration per Stoorez Terms after Stoorez decision.
- Stoorez does NOT insure stored goods, vehicles, or property.
- All insurance (building or contents) is the sole responsibility of Host and Seeker.
- Platform liability, even if proven, is capped at ₹8,000 or 3 months' total platform service fees paid by the affected party, whichever is lower.
- No liability for:
- Consequential, indirect, or punitive damages
- Third-party claims (neighbors, society, authorities)
Abandonment/Overstay:
If goods/vehicles are left after booking:
- Hosts follow legal notification process, then may remove/dispose.
- Any damage in this process is the Seeker's risk post due process.
Multiple Users/Shared Spaces:
In common-access storage/parking, all co-Users indemnify Stoorez and Host from "third-party" damage unless gross neglect is proven.
Authority Seizure:
If property is seized by municipal, police, or court order (for illegal storage/parking), all loss/damage thereafter is Seeker's responsibility.
All Users agree to indemnify Stoorez, its officers, and agents against all direct or third-party claims, damages, or legal expenses resulting from:
- Breach of law or community/society norms
- Subletting, misuse, or illegal storage/parking
- Accidents, pollution, or hazardous acts on premises
- Any government or regulatory penalty resulting from their violation
- No waiver: If Stoorez fails to enforce any right, this does not mean future waiver.
- Any invalid legal provision does not affect the rest of the policy.
- The above policy is always subject to the latest platform Terms and the laws of India.
- Stoorez does not accept liability for any loss, damage, penalty, or closure arising from the Host's failure to secure necessary government or society permissions. Hosts indemnify Stoorez against all related costs.
